Terms of Use
By downloading, installing, accessing, or using Super Sound Machine ("the App"), you agree to be bound by this End User License Agreement ("Agreement" or "Terms"). If you do not agree to these Terms, you should not use the App.
These Terms govern your use of all features, content, subscriptions, and services provided through the App.
1. Acceptance of Terms
These Terms constitute a legal agreement between you and the developer of Super Sound Machine ("we," "us," or "our"). These Terms govern your use of all features, content, subscriptions, and services provided through the App.
2. Eligibility
The App is intended for users ages 9 and older. By using the App, you represent that you meet these eligibility requirements.
3. Description of Services
Super Sound Machine is a sound, sleep, focus, and relaxation application that provides features including, but not limited to:
- High-fidelity ambient sounds and lullabies
- Sound mixing and custom sound profiles
- Equalizer and audio customization tools
- Timers and chained timers
- Custom sound creation using user-provided audio files
- Apple Health and Sleep Tracking analysis features
- Lamp mode and customizable nightlight functionality
- Profile sharing and related personalization features
Features and content may change, expand, or be discontinued at any time without notice.
The App is provided for personal entertainment, relaxation, wellness, and informational purposes only.
4. Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes on devices that you own or control, in accordance with Apple's App Store terms and policies.
You may not copy, modify, distribute, sell, reverse engineer, decompile, sublicense, or otherwise exploit any part of the App except as expressly permitted by law.
5. User Content and Shared Profiles
The App may allow you to create, save, import, export, or share custom sound profiles and audio-related content.
When you share a profile using the App, a shareable link or file may be generated using third-party infrastructure providers. Shared links may be accessible to anyone who receives the link.
Shared profiles are intended to contain sound configuration data only and are not designed to include personal information. However, you are responsible for any information you choose to include in profile names or shared content.
You are solely responsible for ensuring that any audio files or other content you import, create, or share using the App comply with applicable laws and do not infringe the rights of others.
6. Apple Health and Sleep Data
Certain features of the App integrate with Apple HealthKit and Apple Sleep Tracking data, subject to your permission.
The App only reads sleep-related Health data that you explicitly authorize through Apple Health permissions. The App does not write data to HealthKit.
Health and sleep-related data accessed through Apple Health is processed locally on your device to provide sleep analysis, trends, charts, comparisons, and other App functionality requested by you.
7. Informational Purposes Only
The App and all related features, including sleep analysis, sleep scores, recommendations, observations, trends, comparisons, statistics, charts, or wellness-related insights, are provided for informational, entertainment, relaxation, and wellness purposes only.
Any statements generated by the App should not be considered medical advice, diagnosis, treatment recommendations, healthcare services, or scientific conclusions.
The App is not a medical device and is not intended to diagnose, monitor, treat, cure, or prevent any medical condition or sleep disorder. Sleep data and related insights may be incomplete, delayed, estimated, or inaccurate.
You should always consult a qualified healthcare professional regarding any medical or sleep-related concerns.
8. Safe Use
You agree to use the App responsibly and safely. You should not use the App in situations where distraction or impaired awareness could create a safety risk, including while driving, cycling, operating machinery, or performing activities requiring full attention.
Extended exposure to high audio volume levels may contribute to hearing damage. You are responsible for maintaining safe listening volumes.
9. Subscriptions and Purchases
Super Sound Machine offers paid options including monthly and yearly auto-renewable subscriptions and a one-time lifetime purchase. Premium access unlocks the full feature set described in the App.
All purchases are processed through the Apple App Store and are subject to Apple's billing terms, refund policies, and subscription management procedures.
Auto-renewable subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in Settings > Apple ID > Subscriptions on your device.
Refund requests are handled by Apple according to Apple's policies. We do not collect or store payment card information.
10. Third-Party Services
The App may rely on third-party platforms and infrastructure providers, including Apple services and cloud service providers, to support functionality such as purchases, cloud syncing, universal links, profile sharing, diagnostics, and HealthKit integration.
These providers may process standard technical information as necessary to operate their services. We are not responsible for the availability, security, or operation of third-party services.
11. Intellectual Property
The App, including its software, design, audio content, graphics, text, branding, trademarks, and other materials, is owned by us or our licensors and is protected by intellectual property laws.
Except for limited personal use expressly permitted under these Terms, no portion of the App may be copied, reproduced, distributed, modified, or used without prior written permission.
12. Availability and Performance
We strive to provide a reliable experience, but we do not guarantee that the App will always operate uninterrupted, error-free, or without delays.
You acknowledge that use of the App is at your own risk.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
14. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the App.
Our total cumulative liability for any claim relating to the App shall not exceed the amount you paid for the App or subscriptions during the twelve (12) months preceding the event giving rise to the claim.
15. Changes to the App and Terms
We may update, modify, suspend, or discontinue any part of the App or these Terms at any time. If we make material changes to these Terms, continued use of the App after the updated Terms become effective constitutes your acceptance of the revised Terms.
16. Termination
We reserve the right to suspend or terminate access to the App if we believe you have violated these Terms or used the App in a harmful or unlawful manner.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the United States and the laws of the state in which we operate, without regard to conflict of law principles.
